For most people, Halloween conjures scary images of witches, goblins, and ghosts. But for many workers, there are other fears lurking in the shadows all year: like the fear of being reprimanded, laid off, or stuck in a dead-end Job. According to Ford R. Myers, president of Career Potential, LLC, and the author of "Get the Job You Want, Even When No One's Hiring," "the American workplace is largely driven by fear. Most bosses use fear as a mechanism to control and drive the employee's activity." - Job
Fear #1: What if I get laid off?
Given the unemployment rate, layoffs are a chillingly real possibility for many workers. However, you can cope with that fear by actively building your network. "Regardless of whether you believe you'll be laid off, you should proactively engage in your professional community," says Michael Woodward, PhD, an executive coach and the author of the "The You Plan." "Belong to your professional association or community organizations. ... The difference between those who stay unemployed and those who are quickly able to get back on their feet is that the latter have strong networks."
Fear #2: If I don't get laid off, but others do, will I be able to handle the added responsibilities?
When companies downsize, often the best employees get "rewarded" with more work. This can cause job-performance anxiety, especially if the new tasks are outside your skill set or if you're afraid of adding another project to your to-do list. In this situation, Woodward suggests reaching out to your boss and coworkers for guidance. "Knowledge helps create certainty," he says. "You could wallow in that stress or you could say, 'I need some clarification on a couple of points.' It's an opportunity to broaden your skill set and to make yourself more valuable in the future."
Fear #3: Will I be underemployed forever?
Often younger workers end up in support roles where they may not feel challenged. More-experienced workers can also wind up in this predicament due to a layoff or workforce re-entry. However, thinking ahead to your next position keeps things in perspective when it feels like you're endlessly folding t-shirts or fetching coffee. "The smart person does not just ... do what the boss tells them and nothing more," says Myers. "They should consistently grow their credentials. Step up for the juicier, more challenging assignments. Show up earlier; leave later." Remember, the old model of your boss or human resources managing your career is no longer applicable. It's up to you to determine your next steps.
Fear #4: What if my boss yells at me again?
A boss who yells or criticizes you in front of others can really damage morale, so Myers advises that people be "very, very careful about the culture that they choose." Another thing, he says, "is to be very proactive and clear with your boss when you first get hired about how you establish the relationship and set the right precedent." If you're already in a job with a toxic boss, you can sometimes manage a situation (and prevent future problems) by discussing it in a calm, nonthreatening manner. "Don't bring it up in public and don't point fingers," Myers advises. "Say to your boss, I have a concern about something that happened. I'm not sure what your motivation was. I may have misunderstood, but this was my perception; I'd like to get your take on it."

Re New Your Work In 2011
Sometimes, a job--even a pretty good one--can start to feel like it's "going nowhere." But although you may want to advance your career, you may not be in a position to look for a New Job. Maybe you're in an industry where staffing is still tight. Or maybe you just started a new job, and you'd like to put in a few years before moving on. Or maybe you can't take a financial risk right now.
Whatever the case, there are small changes you can make that will boost your Career without giving it a major overhaul. We asked several experts for their tips:
1. Improve relations with your boss.
Your direct supervisor is one of the most important people in your professional life. If that relationship is feeling strained, get back into your boss's good graces by figuring out how to best communicate with him or her, suggests Katherine Reynolds Lewis, a workplace journalist for About.com and the Fiscal Times. "So often, managers have so little time to do the management, so you have to manage up," she says. Ask your supervisor if you can schedule a weekly check-in meeting. Or if your manager is more spontaneous, strike up a conversation and subtly mention your latest accomplishments. "Don't assume that your boss knows when you've done a great Job," urges Lewis.
2. Beat procrastination or lateness.
If you struggle with tardiness or procrastination, then Fearless Career coach Victoria Ashford suggests owning up to the weakness and enlisting coworkers to help you stay accountable. 5 New Year's Career Resolutions for 2011 !

There's just something about opening a calendar for a new year that inspires us to improve our lives. So it's no surprise that New Year's career resolutions often focus on big goals--such as a promotion or a new Job.
And that's why many resolutions get tossed aside by the second week in January, according to Tracy Brisson, founder and CEO of The Opportunities Project. "We get overwhelmed when we realize that outcomes are not always in our control," she explains. But Brisson says that there are plenty of attainable goals--such as adding people to your network or committing to read one business-related book per month--that can add up to Career success.
Sara Sutton Fell, CEO of Flexjobs.com, recommends a mix of easy-to-achieve and lofty goals. She says, "The important part is to choose goals that are directly related to making you more successful in your job."
Here are some other suggestions from the experts:
Hone your elevator pitch.
For Jasmin French, principal of the personal branding firm J. French, it starts with honing your personal brand. French advises doing a simple inventory, "What did you do in 2010 that has transferable value to your employer or potential employer in 2011?" Then, she says, turn that into a succinct (60 seconds or less) pitch on what you are uniquely positioned to do better than anyone else.
French also suggests that you get people to start talking about you by updating your LinkedIn profile with any certifications you've earned or classes you're taking, as well as forwarding relevant articles. "Create your own buzz. It's self-promotion, but it's not shameless."
Brush up on hard skills.
Victoria Ashford, a leadership and career coach at Fearless Leading, suggests heading back to school for additional education, certification, diplomas, or language skills. "Once you have the knowledge and skill, it's yours forever--hard to take away," she notes. "Industries and work environments change, so make sure you're keeping up. Be intentional about your knowledge base and upgrade or update it now."
Solidify your soft skills.
While you're admiring that new diploma hanging on the wall, Ashford cautions that you shouldn't forget about "soft" skills, such as business etiquette, body language, and personal accountability. "Master the arts of introductions, conversation, and establishing professional presence. Ask others to judge your handshake, table manners, and posture," she advises.
A University of Illinois study concluded that 55 percent of the first impression you make is based on your appearance and your body language. And while first impressions are made within the first 30 seconds of meeting someone, it can take up to as many as 21 interactions to undo a bad first impression. French says, "If you want to be known for being detail-oriented, hem your pants, polish your fingernails, or iron that shirt."
Work better with others.
Susan Bender Phelps, a trainer and speaker with Odyssey Mentoring, urges employees to treat everyone they work with as if they are a customer. "Everyone includes your company's management team, your direct supervisor, even your cubicle-mate. Provide knock-your-socks-off service."
Bender Phelps says that one place to start is by sharing credit with your team and with everyone in the organization who contributed to a success. "When you do this consistently, you become the kind of leader people will want to follow, regardless of your title." Likewise, acknowledge people when they do great work, and be specific: "Give evidence that demonstrates you understand their work and the difference it made to the organization."
Approach failure as an opportunity.
"Use every failure or mistake as an opportunity to learn and plan for the future," emphasizes Bender Phelps. She recommends paying attention to what you were trying to accomplish, what you did to make that happen, what went right, and what went wrong. By taking time to consider what went into a failed initiative, you can learn what could have been done better--and in the future, if you're presented with a similar situation or project, you'll know what you should do differently.

GM Shares Jump After Record Public Offering

The amount raised could rise to a world record $23.1bn if underwriters exercise an option to sell more shares.
Surprisingly strong investor demand had allowed the carmaker to lift the price of the shares on offer to $33 from the $26 it had initially hoped for.
GM is returning to the market after a $50bn government bail-out.
The Dow Jones Industrial Average closed up 173 points at 11,183, a rise of 1.6%.
Mr Obama said: "Today, one of the toughest tales of the recession took another big step toward becoming a success story.
"American taxpayers are now positioned to recover more than my administration invested in GM, and that's a good thing."
Canada, which pumped in $10bn and owns 12% of the stock, said it too would seek to recover some of its investment by selling part of its stake.
Different ballpark
The day's trading began on Wall Street when GM chief executive Dan Akerson rang the opening bell on the New York Stock Exchange.
"This is a bit better than people had been projecting. As to a year ago, it's not even in the same ballpark," Ron Bloom, the Treasury official in charge of the GM investment told Reuters.
"A year ago, people said, 'You have no exit, you have no strategy. This company is not fixed'."
The carmaker has raised $20.1bn from the sale of the shares. However, an over-allotment option, which will be settled over the next 30 days, would add $3bn to that figure, taking GM beyond the $22.1bn raised by the Agricultural Bank of China's market launch.
The share sale, known as an initial public offering (IPO), will allow the US government reduce its current 61% stake in the company to as low as 33%.
GM returned to profit this year for the first time since 2004. The company made $5bn during the first nine months of this year.
Scott Painter from the US car comparison site Truecar.com believes the IPO is a sign of how well the economic recovery is going.
"I think GM having a strong IPO and pricing it at the high end of the range certainly speaks well of America and confidence in America, and GM is a really good indicator of everything that we've been through over the last couple of years and how the recovery is working out," he said.

Why 'Yes' is so hard for the Irish

They may dress it up as a loan for the banks but it will involve tens of billions of euros. Europe's crisis managers, who have been a busy bunch this year, had not envisaged a situation where a country did not want to be bailed out. Quite the opposite. In setting up various rescue mechanisms they feared the profligate, or those who ran up bad debts, would beat a path to their door.
So when last weekend various officials - some close to the European Central Bank - began briefing that it was only a matter of time before Ireland was bailed out, they did not expect such stout resistance from Dublin.
So why did Ireland try and hold out?
The Irish government is fragile. It faces a difficult by-election. Its hold on power is slight. A bail-out, however dressed up, is a humiliation. It is a judgment on the way the government has run the country.
There is a stigma to being rescued. The image of the Celtic Tiger has long disappeared but the Irish still cherish the memory. For some years they had the fastest-growing country in Europe. To be bailed out would wound Irish pride.
Then there are conditions. One of the reasons that Ireland did so well was inward investment - particularly from the US. Large multinational companies were attracted to Ireland by a corporate tax rate of 12.5%. Others in Europe - including the French and Germans - dislike the tax. They believe it gives Ireland an unfair advantage.
Many government officials in Ireland fear that one condition of a rescue would be to give up their low corporate tax rate. A few days ago, Ireland's Europe Minister, Dick Roche, bridled at the very suggestion. "We are in charge of our own taxes," he said. We shall see what the terms of any loan are.
Then there is the not-so-little matter of sovereignty. Already Irish commentators have focused on the EU Economics Commissioner, Ollie Rehn. When they were not reporting on his visit to an expensive restaurant, they asked: "Is he the most important man in Ireland?" Is this unelected official essentially running the country, was the tone of some of the comment.
There are stirrings of unease here at what Ireland may be giving away. When it was announced that a team of experts from the EU, the IMF and the ECB were coming to Dublin, the opposition leader referred to them as "officials arriving to dictate terms of a bail-out to the government".
Ireland for a long period was enthusiastically European. Many smart people headed to Brussels. They embraced the European identity as a way of distancing themselves from their neighbour Britain. They took great satisfaction in seeing Irish companies buying up big hotels in London.
So there is foreboding as to what a bail-out would signify. One Irish commentator wrote today: "Having obtained our political independence from Britain to be the masters of our own affairs, we have now surrendered our sovereignty to the European Commission."
Brian Lenihan has defended the increasing influence of the officials from Brussels with references to European solidarity. "We share our sovereignty with Europe in relation to currency," he said. "We pool our sovereignty in this area, so if you're pooling your sovereignty, you have to act with your partners in whatever steps you take." Yesterday he spoke of a "very supportive reaction from the wider European family".
What the Irish government is hoping for - if the Bank governor is right - is a narrow deal to restore the liquidity of its banks so they can borrow more easily. That would be less of a humiliation.

It should not be forgotten that when Irish voters were first given a say on what became the Lisbon Treaty they voted "No". Irish independence is both young and keenly felt.
So if the country is forced to accept a full bail-out, questions will be asked about the future. Will Ireland ever regain control over its budget and its economy?
And that is a question being asked not just on the streets of Dublin but in Athens, Lisbon and Madrid.
Ian Martin, writing in the Wall Street Journal observed: "A new model of government without direct accountability to voters is being constructed."
That, of course, is the long-term implication of this crisis. Presuming that the eurozone does not fracture, its flaws are being used to give the European Commission much greater powers of scrutiny and economic management. And this may go further. While everyone focuses on Ireland, Greece and Portugal, the gap between these economies and Germany only widens. The price of saving the euro may be that the stronger countries bail out the weaker - precisely what German voters were told would never happen.
The "ever closer union" that some dream of may be delivered on the back of a battered currency.

So there is foreboding as to what a bail-out would signify. One Irish commentator wrote today: "Having obtained our political independence from Britain to be the masters of our own affairs, we have now surrendered our sovereignty to the European Commission."
Brian Lenihan has defended the increasing influence of the officials from Brussels with references to European solidarity. "We share our sovereignty with Europe in relation to currency," he said. "We pool our sovereignty in this area, so if you're pooling your sovereignty, you have to act with your partners in whatever steps you take." Yesterday he spoke of a "very supportive reaction from the wider European family".
What the Irish government is hoping for - if the Bank governor is right - is a narrow deal to restore the liquidity of its banks so they can borrow more easily. That would be less of a humiliation.
So if the country is forced to accept a full bail-out, questions will be asked about the future. Will Ireland ever regain control over its budget and its economy?
And that is a question being asked not just on the streets of Dublin but in Athens, Lisbon and Madrid.
Ian Martin, writing in the Wall Street Journal observed: "A new model of government without direct accountability to voters is being constructed."
That, of course, is the long-term implication of this crisis. Presuming that the eurozone does not fracture, its flaws are being used to give the European Commission much greater powers of scrutiny and economic management. And this may go further. While everyone focuses on Ireland, Greece and Portugal, the gap between these economies and Germany only widens. The price of saving the euro may be that the stronger countries bail out the weaker - precisely what German voters were told would never happen.
The "ever closer union" that some dream of may be delivered on the back of a battered currency.

Sticking to the budget is hard especially if the given budget is not as big as you expect it to be. Times like this, you need to cut back on your spending. That is why you need to have a budget. If you are unaware as to how much you'll spend, you'll end up spending too much. Stick to a limit and be sure your budget is reasonable. Try to come up with a limit that is enough to buy foods to sustain you for 2 weeks.
A good money saver tip is to cut back on your meat consumption. Meat is priced a bit higher compared to vegetables. Try to make some dishes wherein meat is not the main ingredient. You could cook something Italian with less or no meat at all. Vegetables are good alternatives for meat. There's also gluten if you want.
Sale items are good deals. If you have some coupons, you can use it and you can even have discounts. If the item is on sale, you might want to buy in bulks. Only buy in bulks if you usually use it. Household Budgeting With a Scalpel

Indonesia Job - Long before the current downturn in the economy, I was a frugal person who enjoyed doing household budgeting. I used coupons, drove as little as possible to save money on gas (even when gas was inexpensive), and took my lunch to work. Even being a frugal person, I found myself buying a lot more stuff than I needed, though. When I looked around our house which is large for two people, I saw a lot of things that were simply collecting dust that we didn't use. At that moment, I realized that my husband and I could do a lot better at saving money. After this realization, we got to work using a scalpel to carve out more savings and less spending and this is what we did to save on our monthly budget. - Job Vacancy.
First, we wrote down every bill that we had for the month and asked ourselves if we really needed to spend money on this item or service. We also spent time that month writing down every small purchase that we made in a notebook to chart just how much money was being spent in small increments for items like coffee, newspapers, or lunch. We reviewed the list and found lots of items or services that we could live without.
Cable television - We decided that we didn't watch enough television to justify spending $75 per month for cable television. Instead, we use an inexpensive service that delivers videos via the mail service two or three at a time. We get our news and weather from the internet and received most of the series that we liked on CD.
Cell phone - We were paying approximately $90 for 700 minutes from a well known cell phone service provider. I found a much lower cost and better plan provider from a pay-as-you-go service that uses a network from a large, well-known provider. We now have unlimited minutes and internet access for $15 less per month. We are saving money, getting more services, and we aren't locked into a contract.
Carpooling - My husband and I worked fifteen minutes away from each other. We bit the bullet and decided that the extra 30 minutes of commute time per day was worth it to save money on gas and car maintenance. An added benefit was having someone to converse with on the trip instead of simply listening to the radio.
Eating out at restaurants - We used to eat in a restaurant where the bill averaged between $25 and $40 once or twice a week. While we enjoyed this practice, we realized that we were spending an extra $1800 per year (average $35 x 2 x 52). We limited ourselves to eating out once per month which did save a lot and reduced our waistlines as well.
Buying in bulk - Being a frugal person, I was never very good at buying in bulk because I simply didn't want to spend that much money on groceries (which is probably why we spent so much money eating out!). I realized that I was costing us money by not stocking up on sale items that we really use. I bought a membership to a wholesale club and go once a month. While I spend a lot in one shop, I also save money because I am buying things usually on sale in large quantities. I also save time because I only have to go to the conventional grocery store for items that go out of date like bread, eggs, and salad. We also now
make a concerted effort to eat all of the food that I fix which also saves money and reduces the waste from our home.
Using coupons wisely - I was the worlds worst about using a coupon to get something at a very low cost or free but that we would not use. So, I stopped doing that because I realized that I wasn't really saving money, I was just cluttering up the house.
Limited my shopping - For many years, I have been a thrift store shopper. This is a great way of buying great clothes at inexpensive prices for the entire family. It becomes a problem, though, when you buy a lot of clothes that you don't need. I found that I was going twice or three times per month to my favorite thrift store spending between $30 and $50. I realized that I while I enjoyed shopping; I really didn't NEED all of those clothes. I now limit myself to a thrift store trip once per month and my spending limit is $20. I have less clutter in my closet and we save money.
Revisit our Vacation - We used to take a pretty lavish vacation for ten days per year. We would fly somewhere, rent a car, and stay in a nice hotel (not extravagant but nice nevertheless). We would also treat ourselves to nights out and dinner plus drinks. All of that added up fast! Now, we drive to the beach that is about four hours from our home, stay in a nice but moderately priced condo, and eat in. In fact, cooking on vacation is much less expensive and I have control over how the food is cooked. We also save money by taking in all of the free things that are available (museums, parks, the beach). We still have a wonderful time but have cut the cost of our vacation by about 50 percent.
After a few months of whittling down our budget, we save about $400 per month or $3600 per year which has given us much more financial freedom and peace of mind but we haven't missed anything that we cut out. If you are struggling to save money, I would recommend using a virtual scalpel to cut your budget as well. You can cut out unneeded purchases and watch your savings account grow!

Using coupons wisely - I was the worlds worst about using a coupon to get something at a very low cost or free but that we would not use. So, I stopped doing that because I realized that I wasn't really saving money, I was just cluttering up the house.
Limited my shopping - For many years, I have been a thrift store shopper. This is a great way of buying great clothes at inexpensive prices for the entire family. It becomes a problem, though, when you buy a lot of clothes that you don't need. I found that I was going twice or three times per month to my favorite thrift store spending between $30 and $50. I realized that I while I enjoyed shopping; I really didn't NEED all of those clothes. I now limit myself to a thrift store trip once per month and my spending limit is $20. I have less clutter in my closet and we save money.
Revisit our Vacation - We used to take a pretty lavish vacation for ten days per year. We would fly somewhere, rent a car, and stay in a nice hotel (not extravagant but nice nevertheless). We would also treat ourselves to nights out and dinner plus drinks. All of that added up fast! Now, we drive to the beach that is about four hours from our home, stay in a nice but moderately priced condo, and eat in. In fact, cooking on vacation is much less expensive and I have control over how the food is cooked. We also save money by taking in all of the free things that are available (museums, parks, the beach). We still have a wonderful time but have cut the cost of our vacation by about 50 percent.
After a few months of whittling down our budget, we save about $400 per month or $3600 per year which has given us much more financial freedom and peace of mind but we haven't missed anything that we cut out. If you are struggling to save money, I would recommend using a virtual scalpel to cut your budget as well. You can cut out unneeded purchases and watch your savings account grow!

The Supreme Court held recently in Padilla v. Kentucky that a criminal lawyer must give accurate advice regarding the potential consequences of an immigration conviction. Jose Padilla had spent 40 years in the United States. Although he never gained citizenship, he was a lawful "permanent resident." In fact, he was even a Vietnam vet. He was charged (and later pled guilty) to trafficking marijuana.
His lawyer, at the time of his plea negotiations, had informed Padilla that because he had lived so long in the United States, he did not need to worry about the immigration consequences of his conviction.
However, because marijuana trafficking is an "aggravated felony" under United States law, his guilty plea meant that Padilla was deportable under federal immigration law.
Padilla appealed his conviction, and the Supreme Court found by a 7-2 decision that, in fact, his lawyer's advice that he had nothing to worry about regarding immigration was "ineffective assistance of counsel".
If any attorney is counseling a client regarding a criminal matter, that attorney should first determine whether the client is a citizen or not. The attorney should then determine whether the crime with which the person has been charged is a deportable offense. Even if the offense is not a deportable offense, the attorney should advise the person that laws may change and that by pleading guilty to the crime, the person may in fact be deported upon conviction.

In Canada, the offense of Impaired Driving is a federal offense and comes under the Canadian Criminal Code. There is a standard penalty across Canada if charged criminally with an alcohol/driving related offense. On a first offense, the minimum fine is $1,000.00 and a one year license suspension. Jail time is possible and an option for Judges in sentencing for more serious cases.
The maximum legal blood alcohol content is 0.08% in Canada. However, Provinces are free to institute their own regulations in regard to alcohol and driving on provincial roads. Some provinces such as British Columbia and Nova Scotia have penalties that are immediate such as roadside driver's license suspensions for drivers who are found to have a BAC according to a breath testing machine that are lower than the Criminal legal limit. However, a driver charged under these Provincial regulations are not charged criminally. Although some of these penalties can be severe, if a driver is only charged under a Provincial regulation, they will not have a criminal record.
In the US however, individual States have the authority to legislate laws regarding impaired driving and blood alcohol concentration levels. Each State has its own penalties and sentences that are legislated by the State. Even though all States in the US today have a standard maximum blood alcohol concentration of 0.08%, this has not always been the case. Until recently, there was even a variance in the legal blood alcohol concentration limit among States.
In a survey of penalties for drinking and driving offenses, it was found that there is a huge variance in how many States mete out punishment for those offenses. Some such as Michigan have a fine for a first offence of only $100.00 while other States like Washington have a minimum fine of $1,120.50.
Jail sentences for a first offence also vary greatly. In Pennsylvania, no jail time is legislated if your BAC was between 0.08% AND 0.099%, but in Washington State, you will spend 24 hours in Jail and up to 1 year. A period of electronic home monitoring in Washington is also a possibility.
Some States have varying penalties that depend on your BAC when you were arrested. In Michigan, having a BAC of greater than 0.17% is now considered a "Super DUI" and carries increased penalties upon conviction.
As well, there are places in the United States where an impaired driver faces greater penalties if they were driving with a passenger under a certain age. In some States, this age is 21, while others have legislated more severe penalties for transporting a minor under 16 years old.
